Motion dismissed

The opposition has succeeded in getting the Supreme Court to proceed with its reference hearing tomorrow

Supreme Court dismissed Notice of Motion against Opposition's Substantive Application as incompetent.

A supreme court bench comprising five senior judges Justice Allen David, Justice Joseph Yagi, Justice Jacintha Murray, Lawrence Kangwia and Justic Hitelai Polume-Kiele ruled that the motion by the Attorney General set aside the orders to hear the  reference tomorrow is incompetent.

The bench has unanimously dismissed it. From the Notice of Motion and Submissions from the Attorney General as the Second Intervenor, there were two main issues emerged for Supreme Courts consideration.

The first issue is whether the Motion should be dismissed for being incomplete  and second is whether the application to set aside the orders of 19 July to be submitted with the orders as proposed in the motion.

As per the formal orders ended down unanimously by five men bench this morning, Second Intervernor's Notice of Motion is incompetent without merit and is dismissed.

Also the Supreme Court ruled that cost of and incidental to the application is awarded in favor of Substantive Applicant.

Meanwhile outside of court the happy Opposition team leader said this means the substantive hearing will proceed tomorrow.

Lawyer George Kult has also confirmed and Mr  Tomuriesa says it's good news for Papua New Guinea.

"This is a good news for PNG now and we see that our court systems have been respected by the opposition.

"We believe that the judgement will be fair not only for the opposition but for the people of PNG and the Substantive matter will be held tomorrow," Douglas Tomuriesa said.
