The Supreme Court has restrained the PNG Electoral Commission [PNGEC] from carrying out a by-election for Madang electorate.

Presiding Judge Bethuel Dingake made this order while making a ruling on an interim stay application filed by Bryan Kramer the former member for Madang District.

He says PNGEC is restrained from carrying out a by-election as it would prejudice Mr Kramer as he has a substantive matter yet to be dealt with at the Supreme Court.

His substantive matter is a supreme court review application which is challenging the decision of a leadership tribunal to remove him as an open member for Madang District.

Kramer's counsel, Nelson Kupunyo explains that the orders this morning has restricted PNGEC from carrying out a by-election until Kramer's substantive matter is dealt with.

He says this is a relief Kramer has been seeking and it will ensure justice is preserved for both parties.
